Furcord Group respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512). We respond expeditiously to copyright infringement notifications, disable access to infringing material, and enforce a repeat infringer termination policy.

2. Statutory Requirements for a Valid Takedown Notice
To be legally effective under 17 U.S.C. § 512(c)(3), an infringement notification submitted to our Designated Agent must be a written communication containing:
- A physical or electronic signature of the copyright owner or an individual authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Clear identification of the copyrighted work claimed to have been infringed (or, if multiple works are involved, a representative catalog of such works).
- Specific identification of the material claimed to be infringing, along with information sufficient to permit Furcord Group to locate the item on the platform (including server IDs, channel IDs, message links, and timestamps).
- Full contact details of the complaining party (legal name, physical mailing address, telephone number, and active email address).
- A statement affirming that the complaining party has a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement made under penalty of perjury that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the owner.
3. Takedown Actions & User Notification
Upon receiving a legally compliant DMCA notice, Furcord Group will:
- Expeditiously remove or disable access to the identified infringing material;
- Promptly notify the affected user who posted the content;
- Provide the user with a complete copy of the written takedown notice, including the complainant’s identifying contact details.
4. Counter-Notification Procedures
If you believe your content was improperly removed or disabled due to misidentification or mistake, you may file a formal counter-notification under 17 U.S.C. § 512(g). The counter-notice must be delivered to our Designated Agent and include:
- Your physical or electronic signature.
- Identification of the specific material that was removed or to which access was disabled, and the location where it appeared prior to removal.
- A statement made under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your legal name, physical address, and telephone number, accompanied by a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your physical address is located (or Lubbock County, Texas, if you reside outside the United States), and agreeing to accept service of process from the original claimant.
Upon receipt of a valid counter-notification, Furcord Group will forward a copy to the original complainant. Unless the copyright owner files a court action seeking a restraining order against the content provider within ten to fourteen (10–14) business days, Furcord Group may restore the removed material.
5. Repeat Infringer Policy (17 U.S.C. § 512(i))
Furcord Group enforces a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are found to be repeat or systematic copyright infringers.
